In the course of doing an intake with a potential new client, it is especially important to keep an ear tuned for legal claims or issues the client may have and are unaware of that are different or more significant than the one they initially thought they needed you for.
In doing a Social Security Disability intake today, I learned that the client had sustained what sounded like a rather serious head injury while working a number of months ago. She received minimal treatment from the company doctor and was told she she was no longer needed and released from employment. She continued to struggle, believing that her workers compensation case was closed.
Further questioning, and a quick check of the Connecticut workers compensation online data base revealed that the workers comp case was still open and that a voluntary agreement had actually been approved. Thus, this particular woman, who was still experiencing very significant problems from the work injury, could hire us to get her appropriate treatment and ultimately, financial compensation down the road.
This is not an unusual story. Every week I speak with someone that has a claim they did not know existed, and every week we turn these into viable claims for benefits.
