Does Workers' Compensation Cover My Drive To and From Work?

 Connecticut employers are responsible for providing workers’ compensation benefits to employees while on the job, but have you ever thought about whether or not you are covered during your commute to and from your job?

 

In general, the answer to whether or not workers' compensation benefits apply to an employee's commute is no. This is known as a “coming and going” rule of workers' comp. This rule excludes injuries obtained while in traffic on an employee's everyday commute to and from the job. A notable exception to this rule is police officers who are covered "port to port" if they sustain a work injury in Connecticut.

While employees are generally not covered on their typical commute, there are situations that can be covered by workers' compensation when you are away from your job site. They include:

  • Being injured while at a mandatory work function or party off-site
  • Being injured while using a company car on your commute
  • If driving is your primary job and you are injured while driving for work. Occupations could include driving a bus, driving a large hauling truck, or patrolling as a police officer.
  • Being injured while on a trip for business, even if the injury takes place outside of your typical working hours
  • Any other general driving solely for work purposes that results in an injury

In addition, on-call employees could receive Connecticut workers' compensation benefits beginning the minute they are called to come into work, even if the injury takes place in their home.
